Divorce in Islam: Rules and Principles #gracefulseparation


 

Translation:

Divorce can happen twice, after which a husband should either keep the wife with kindness or let her go with grace. It is not lawful for the husband to take back anything he has given to his wife unless both fear that they will not be able to uphold the limits set by Allah. If there is a fear that they cannot maintain these limits, then there is no blame on either of them if the wife gives something (as compensation) to end the marriage. These are the limits set by Allah, so do not cross them. Whoever crosses the limits set by Allah is indeed among the wrongdoers.

طلاق دو مرتبہ ہے، پھر بھلائی کے ساتھ روک لینا ہے یا نیکی کے ساتھ چھوڑ دینا ہے، اور تمہارے لیے اس میں سے کچھ بھی لینا جائز نہیں جو تم نے انہیں دیا ہے مگر یہ کہ دونوں ڈریں کہ اللہ کی حدیں قائم نہیں رکھ سکیں گے، پھر اگر تمہیں خوف ہو کہ دونوں اللہ کی حدیں قائم نہیں رکھ سکیں گے تو ان دونوں پر اس میں کوئی گناہ نہیں کہ عورت معاوضہ دے کر پیچھا چھڑا لے، یہ اللہ کی حدیں ہیں سو ان سے تجاوز نہ کرو، اور جو اللہ کی حدوں سے تجاوز کرے گا سو وہی ظالم ہیں

Limited Divorce: A man can divorce his wife only twice in a reversible manner. After the second divorce, he must make a clear decision—to keep her respectfully or to let her go kindly.

Fair Treatment: The wife must be treated with kindness and respect, even if the decision is to separate.

No Taking Back Gifts: The husband cannot reclaim the dowry or gifts he has given his wife unless both fear they cannot adhere to Allah’s laws.

Khula (Compensation): If mutual understanding cannot be achieved, the wife has the right to seek separation through compensation, called Khula.

Respect for Allah’s Limits: The verse warns against exceeding the boundaries set by Allah, as doing so leads to injustice and wrongdoing.
